Members of the American Party believe that the original Constitution of the United States and the Bill of Rights were prepared and adopted by men acting under inspiration from Almighty God, that they are solemn compacts between the people of the states of this nation which all officers of government are under oath to obey, and that the eternal moral laws expressed therein must be adhered to or individual liberty will perish.

The purpose of the American Party is to field candidates who will restore the proper role of government as defined in the Constitution of the United States and interpreted in the tradition of our Founding Fathers. We therefore call for all citizens to inform themselves and enter the political arena with time, money, and dedicated service in order that the government of the people, by the people, and for the people may not perish from the earth.
The proper role of government is limited to those spheres of activity within which the individual citizen, in the absence of government, had the right to act. By deriving its just powers from the consent of the governed, government becomes primarily a mechanism for defense against bodily harm, theft, and involuntary servitude. It cannot claim the power to redistribute money or property, nor to force citizens to perform acts of charity against their will.
The American Party offers this platform in the sincere belief that these positions on the most important issues of the day are both right and necessary for peace, prosperity, justice, and domestic tranquility.

Domestic Policy

Agriculture


We favor the termination of government production, price controls, and subsidies. Fair two-way trade is essential for agricultural prosperity. We recognize the need for protection from foreign imports which have been produced by Communist/Socialist slave labor or subsidized by a foreign government.

Business


It is not the function of government to meddle in the conduct of private enterprise and it is equally inappropriate for the government to rescue failing business.
The federal government is notoriously inept at running a business. The solution is to divest the government of all commercial enterprises and sell them to competitive, private businesses.

Constitutional Convention


We oppose the convening of a Constitutional convention or a conference of states to alter the Constitution because of the danger of perversion of this inspired document.

Crime


The primary concern of government at all levels should be the safety of the lives and property of law-abiding citizens, not the rights of criminals. The most effective deterrent against crime is the certainty of apprehension, speedy conviction, and fitting punishment. Fitting the punishment to the crime requires restoration of the death penalty for crimes of violence and for treason. It also rules out plea bargaining and demands greater uniformity of sentencing for convictions for the same crime. We support the autonomy of local law enforcement.
We favor restitution laws, where possible, requiring criminals to reimburse those injured by their crimes. They should also be required to perform useful work to defray the costs of the imprisonment. We oppose the continued moves of the federal law enforcement to federalize crimes heretofore under the jurisdiction of the states.

Education


The present crisis in education must be solved in stages and at several levels. First, so that no parents need defy the law by refusing to send their children to schools of which they disapprove, compulsory attendance laws should be repealed. Second, the control of schools should be returned to the local system by congressional limitation of the jurisdiction of federal courts and by an end to busing for racial balance. Third, the federal government should be eliminated entirely from interference in local schools by putting an end to federal aid. There should be no federal government control of textbooks. The selection of textbooks and approval of their content must be the responsibility of parents and local boards of education. We oppose the federal government's role in education including, but not limited to, the Federal Department of Education, "Goals 2000", "No Child Left Behind", and the total National Education Association agenda.
Fourth, the only permanently satisfactory solution to the many problems of general education - busing, curricula, discipline, drugs, the ban on prayer in schools - is decentralization of the educational system and the adoption of free enterprise methods. The education of children is the God-given responsibility of their parents, and private schools should be available without the additional burden of public (government) school taxes. Control over school policy and subject matter must be vested in the parents. To this end the American Party applauds those parents who are courageously offering their children academically superior education in private schools or at home, and extends the grateful thanks of the nation to them for refusing to relinquish the education of their children to the state.

Elections


The manner of conducting elections is the prerogative of the states according to the Constitution and this responsibility is not to be usurped by the federal government except the qualfications for the offices of President and Vice-President which are set forth in Article II, Section 1 paragraph 5 of the United States Constitution. The Federal Election Commission serves chiefly to harass independent and minor party candidates. In so doing, it abrogates the Constitutionally guaranteed franchise of many voters. It should, therefore, be abolished.
The appropriation of tax money to finance conventions and candidates is using money paid under compulsion to promote programs to which, and persons to whom many taxpayers are strongly opposed. Such use of public funds is, therefore, immoral and should be abolished.

Energy Policy


The free enterprise system will adjust available energy sources to consumer demand if the producers of oil, gas, and coal are not hamstrung by punitive or politically motivated price controls, and taxes on the production and distribution of energy. We call for the complete decontrol of energy production.

Executive Orders


The Constitution specifies that only Congress may enact laws and that it may not delegate its legislative powers. Therefore, though the President may issue executive orders to administer the executive branch of government, neither the President nor any other officer may create laws decreed by executive agencies such as OSHA and the IRS. All such existing so-called laws should be declared void and further executive orders forbidden.

Family Rights


A family consists of a man and a woman joined by matrimony and children - whether natural or adopted. If one of these parents, through death or divorce is removed, the family unit still exists and is the basic unit for stability in the life of the individual and the strength of the community and nation. We applaud those States which have passed joint custody laws for children. Children have a mother and a father.
Our forefathers in their wisdom did not include the regulation of family life in our limited federal constitutional government. We affirm the rights of families to direct the upbringing of children as well as the care of elderly and handicapped members. Child care or the regulation of child care is not a legitimate function of the federal government but is an unconstitutional intrusion into the private affairs of American families. We oppose the intrusion into the family by any state government agency unless absolutely necessary to protect children or adults from truly abusive situations. Even in these situations due process must be accorded all parties involved. There shall be no presumption of guilt based on anonymous "tips" and those accused must have the right to face their accusers in a court of law.

Federal Judiciary


Federal Courts have for too long indulged in widespread judicial legislation which is a clear usurpation of power. They should be returned to the proper function of interpretation and adjudication by any or all of several means. The simplest is congressional limitation of the powers of the Supreme Court and other federal courts, as provided in Article III, Section 2 of the Constitution. We also favor the impeachment of judges who cannot cite clauses of the Constitution to defend their decisions.
Countries which do not observe the rules of evidence of U.S. courts should not be allowed to introduce evidence into U.S. trials.

Gun Control


The right of citizens to keep and bear arms, whether for sporting purposes, personal defense, or as a deterrent to tyranny, is guaranteed by the Second Article of the Bill of Rights and is not to be infringed. The purpose of the government is not the control of law-abiding gun owners but the control of criminals. We favor heavy mandatory state penalties for violent crimes. We oppose all laws existing and proposed that would infringe upon the right of the people to keep and bear arms.

Health Care


We support the people's right to choose any modality of health care. We view the termination of pregnancy as premeditated murder - not as health care.

Homosexuality/Lesbianism


Homosexuality and lesbianism are a plague sweeping the nation and creating a wave of disease and immorality. Normal sex is an intimate relation between a man and a woman. All homosexual relations are acts of sodomy. People engaging in such acts should have no special rights or privileges and those living in such relationships have no familial rights or privileges such as adoption of children and legitimacy of marriage.

Illegal Aliens


We are opposed to all illegal aliens and, therefore, support laws and enforcement to deport them.

Inflation


Inflation is the insidious theft of our buying power for which only government is to blame. Many decades of reckless deficit spending by Congress and monetary manipulation by the Federal Reserve system, have brought America to the brink of fiscal and monetary disaster. We must return to an honest money system, backed by gold and silver and the elimination of fractional reserve banking. The Federal Reserve system is a cartel between the government and the banks which must be abolished.

Labor


Labor rates must be established by the marketplace and not by government. Union membership and dues must be entirely voluntary. We favor the repeal of the National Labor Relations Act. We support Right-to-Work laws.
The use by unions of labor, donations, equipment, and money obtained from union dues and pension funds to control the candidates of political parties is both immoral and illegal. Those guilty of giving or receiving such funds should be prosecuted just as certainly as corporations which break the laws concerning campaign contributions.
Government workers hold their jobs as a privilege, not a right, and essential government services must not be interrupted by strikes by public employees. Collective bargaining by public employees must therefore be made illegal.

Land Use


Land use laws are federal zoning laws or federally instigated State zoning laws. As such, they effectively confiscate or reduce the value of privately owned land without due process or compensation. We oppose such laws as tyrannical and oppressive and because they are an invitation to wholesale corruption. We also oppose federal flood control insurance and its built-in-land-use provisions. Federally controlled lands such as those under the Bureau of Land Management, the National Forest Service and the National Park Service, which are held contrary to Article I, Section 8, paragraph 17 of the U.S. Constitution should be deeded to the respective States. We encourage the state attorney general to bring suit in the U.S. Supreme Court for the release of these lands.

National Security


The United States must defend itself against espionage, sabotage, subversion, sedition, and terrorism, or it will succumb to its foreign and domestic enemies. The full power of the Federal Government should be applied to the apprehension, conviction and punishment of persons guilty of these high crimes. We call for the reestablishment of and vigorous support for the House Internal Security Committee, the Senate Internal Security Subcommittee, and the Subversive Activities Control Board. All loyalty and security risks should be dismissed from government service.
Treason is defined by the Constitution and specified as a capital crime. We call for the enforcement of this provision of the Constitution.

No Punishment Without Proof of Guilt


No person shall be punished for engaging in any business unless first convicted in a court of law of having committed a crime in the operation of such business. The right to a prompt trial by jury shall be guaranteed to the accused in all cases in which the freedom or right to operate a business or use land is an issue. When a trial by jury is demanded, the jury shall determine criminal intent, the law, the facts, and the penalty unless each is specifically and voluntarily waived by the parties involved.

Public Morality


Neither Congress nor the federal courts should infringe the rights of state and local governments to enact constitutional laws restricting public obscenity, pornography, and illicit sex acts, especially prostitution and homosexuality.
Tax dollars must not be used to finance immoral art, literature, speech or actions.

Regional Government


Regional and metro government run by appointed bureaucrats is a device to impose direct federal control on metropolitan areas and to bypass State and local sovereignty performing an end run around the Constitution and backers of such schemes themselves admit it. As such, it is a blow against local control of representative government and should be abolished. No appointed official should have authority equal to that of elected officials within the same jurisdiction. The creation of regional government is in violation of the principles of the Constitution and is a brazen act of treason against our country.

Sanctity of Life


The paramount responsibility of any government is to protect the life of each person within its juirisdiction. Though it may be superficially plausible that a pregnant woman should have complete control over her own body, neither she nor anyone else may extend that right of control to the body of the unborn child she carries. Government is obligated to protect the life of both child and mother and, if necessary, to protect the life of the child from the mother.
The intentional termination of life at any time after conception is murder. We oppose abortion and euthanasia as such and any doctor, nurse, assistant, or anyone else involved must be prosecuted to the fullest extent of the law.

Social Security


Social Security is a bad bargain for those not already drawing benefits; future benefits will return only a small fraction of the values paid in and there is no guaranteed minimum, no cash value. Because Social Security is administered under the compulsion of government power, it also violates God-given, inalienable rights. Since it has proven to be impossible, both politically and economically, to fund it on a sound basis, it should be phased out. There is a moral obligation to honor all present liabilities to those who are dependent upon Social Security and to those who have been required to contribute but are not yet receiving payments. Immediate steps should be taken, however, to transfer the entire program to private companies which offer both more sound and advantageous retirement plans.

Taxes


Taxes should be levied and collected solely for the financing of the constitutional functions of government. If every government program were to be judged by this criterion, and if those which could not be justified by constitutional sanction were eliminated, the cost of government would be drastically reduced. We call for such a scrutiny of federal programs and for the elimination of those which are unconstitutional, to be followed at once by a reduction of taxes to a level at which the federal budget would be balanced.
Bank accounts should be immune to inspection by federal agencies. We believe that the solution to the injustices and intimidations committed by the Internal Revenue Service is the elimination of the IRS. Only then can American citizens be protected from capricious intrusions by the Federal Government into their private financial affairs. Most taxpayers cannot risk possible financial ruin by contesting dubious or even outrageous IRS rulings in administrative courts where the virtually inexhaustible legal resources of a powerful branch of the Federal Government can be pitted against them.
Any government which taxes some of its citizens in order to win elections by subsidizing favored factions of the electorate, is incompatible with freedom and property. It encourages fraud, sloth, and disrespect for the law, and at the same time, discourages potential employers, savers, and investors. All taxes should be direct, highly visible, and apportioned so that everyone has an equal interest in keeping them minimal.
To the extent that revenues are necessary to finance the constitutional functions of the Federal Government, we propose that such revenues be derived only as specified in the Constitution.

Tenth Amendment Resolutions


The federal government was created by the States specifically to be an agent of the states. Today, however, the states are being treated as agents of the federal government. We affirm the states' sovereignty under the tenth amendment to the Constitution and demand that the federal government cease and desist mandates which are beyond the scope of constitutionally delegated powers.

Warfare on American Citizens


We decry the actions of various branches and agencies of the federal government as occurred during the siege of the Branch Davidians in Waco, Texas; the bombing of the Alfred P. Murrah building in Oklahoma City and against the Randy Weaver family in Ruby Ridge, Idaho. We demand that a full investigation into these events be carried out and the perpetrators be prosecuted to the fullest extent of the law.

Welfare


Federal welfare programs are unconstitutional, needlessly expensive, and riddled with corruption. They should be abolished, leaving such concerns to the several States, counties, municipalitities, churches and private charities.
Abolishing or phasing out these federal programs will reduce the need for welfare to a level with which State and local government can cope.

Foreign Aid


Foreign Aid is an international welfare scheme by the Federal government. It is wasteful and retards the sound economic growth of the people supposed to be aided. Foreign aid must be stopped at once. To this end we oppose all United States contributions to the International Monetary Fund, the Export-Import Bank, and similar institutions. We oppose taxpayers' guarantees of foreign loans made by private banks, especially loans to our Communist-Socialist enemies.

Hemispheric Defense


Failure to assert and apply the Monroe Doctrine led to the establishment of the first totalitarian state in the Western Hemisphere. The Monroe Doctrine must be reasserted by giving every possible non-military form of assistance to those seeking to restore free government in their countries.

Intervention


The United States must defend its own true interests in all parts of the world. This requires non-intervention and non-involvement. The U. S. must not orient its foreign policy to conform to the interests of any foreign nation or organization.

Mia's and Pow's


We call for a complete investigation of government attempts to conceal, for political reasons, the names of missing Americans who were or may still be in enemy hands. We call for the government to take immediate measures to bring heavy pressure to bear upon any governments holding Americans. There is substantial evidence there are nations still holding Americans against their will.

Military Strength


We have enemies whose purpose is to destroy America and the free world. It is suicidal for this country to disarm. We must have a military establishment able to defend our sovereign nation against any combination of enemies. We oppose the transfer of goods, money, or technology to our enemies or to their suppliers. We should not lose our freedom by surrender and default. We call for military systems such as the Strategic Defense Initiative which can and will defend this country against our enemies. Strong civil defense is an essential component of national preparedness.
Our armed forces should treat as hostile all military craft of foreign nations which trespass our air space or coastal waters.

New World Order and World Government


"New World Order" means world socialist government. This great evil is promoted as a way for the United Nations to function as envisioned by its founders.
Necessary companions of world government are world taxation, centralized world regulation of commerce, international control of the production and consumption of oil, a single world currency, and a world army to enforce the above.
A casualty of implementing the "New World Order" will be national sovereignty and the Constitution of the United States. The American Party is unalterably opposed to world government and to the "New World Order."
It is for this reason we oppose such treaties as NAFTA, GATT-WTO and other UN conventions as destructive of national sovereignty and as attempts to circumvent the Constitution of the United States.

Offshore Resources


We must protect and enforce exclusive private American claims to offshore oil, gas, and mineral resources, as well as fishing rights to a distance of 200 miles. Stern measures should be taken against foreign ships' harassment and destruction of American fishing in American waters. We oppose the autocratic ban on offshore energy development. We support the use of Alaskan oil rather than Middle East oil. We support a second parallel pipe line for the development of Alaskan natural gas rather than a pipeline across Canada.

Panama Canal


The Panama Canal Treaties were not validly ratified by the Senate or with the necessary approval of the House. The treaties passed by the Senate differ from those signed by Panama. We, therefore, call for their denouncement and for the reassertion of American sovereignty over the Panama Canal and Canal Zone by the enforcement of the DeConcini condition and the removal of Red Chinese or any other foreign authority over the Canal.

Secret Diplomacy


Ours is not a government of, by, and for the people if we allow Presidents or Secretaries of State to bind us with secret treaties. We declare that no treaty or agreement should be honored unless it is made public and ratified by the U. S. Senate as required by the Constitution.

State Department


For more than four decades, the Department of State has been a scandal-ridden haven for known loyalty and security risks. Loyalty and security risks should be identified by a careful and thorough investigation and dismissed from government service. The State Department is vastly overstaffed and should be cut back drastically.

Treaty Law


Americans are not secure in their Constitutional rights if such rights can be superseded by provisions of any treaty.
The President does not have the Constitutional authority to terminate treaties without the consent of the Senate. We call for the establishment of normal diplomatic relations with the Taiwanese government.
The Genocide Convention must be repealed. No world court or other international body has jurisdiction over American citizens. No U. S. citizen may be tried by the ICC.

United Nations


Since the United Nations has been in existence, more people have lost their lives, homes, possessions, and freedoms than in any similar period in history. Totalitarian Communist-Socialist regimes cast hundreds of vetoes in the UN Security Council to make the world safe for themselves, and they and their satellites control the UN General Assembly while the American taxpayer foots the lion's share of the bill for keeping the UN going.
All financial support to the United Nations and to any of its agencies must stop immediately, and all foreign delegates, staff and other employees should be required to leave the United States at once.
We support the courage and convictions of military personnel who refuse to be compelled to serve as U. S. soldiers under UN command and we oppose all attempts to force U. S. military to serve under U. N. command or wear U. N. insignia.

War


Our military involvements in Korea, Vietnam, Bosnia, Kosovo and the Persian Gulf were undeclared wars. We, therefore, would require that foreign military actions cannot be pursued more than 72 hours without a declaration of war by Congress. We denounce any no-win policy as treasonous. It is immoral to draft anyone to fight in an undeclared war.
